Nokia says RIM has breached patent agreement, takes legal action

Posted on 6:58 AM by Unknown

Finnish handset maker Nokia Corp. Wednesday said it has filed suits in courts in the U.S., U.K. and Canada against Blackberry handset maker Research In Motion Ltd for allegedly breaching a patent licensing agreement.

In a statement, Nokia claimed that its Canadian peer can't sell devices equipped with wireless local area network technology, known as WiFi, without first agreeing with Nokia on royalty terms.

Nokia has a patent licensing agreement with RIM, that was extended late in 2008. However, Nokia claims that the deal covers essential patents for GSM, WCDMA and CDMA2000 mobile technologies, while RIM argues that the license also covers WLAN technology.

Mark Durrant, Nokia's spokesman on legal matters, said an arbitration tribunal in Stockholm ruled against RIM in the matter, finding RIM in breach of its contract. The latest legal action is aimed at getting official recognition of the Stockholm arbitration ruling, so allowing Nokia to take further action.

The Stockholm arbitration ruling is confidential and RIM declined to comment on the matter.

Nokia is also involved in a separate patent suit against RIM after filing claims at courts in the U.S. and Germany in May this year, alleging that products from the Canadian company, as well as products from rivals HTC Corp. and visual technology company Viewsonic Corp., infringe a number of its patents.
