Kenyan contenders facing ICC cases to run jointly in vote

NAIROBI (Reuters) - Two Kenyan presidential hopefuls indicted by the International Criminal Court (ICC) for allegedly inciting post-election violence said on Sunday they would join forces in next year's vote and run on the same ticket.

Deputy Prime Minister Uhuru Kenyatta, son of the Kenya's first president after independence from Britain in 1963, will seek the presidency while former cabinet minister William Ruto hopes to be vice president, according the deal.

The election will be the first under a new constitution and the first since the 2007 poll that led to violence in which more than 1,200 people died. Kenya had previously been a relative haven of peace in a troubled region.

The Hague-based ICC said in July that four prominent Kenyans, including Kenyatta and Ruto, would be tried for their alleged roles in fuelling bloodshed. All deny wrongdoing.

There are fears Kenya could face a political backlash or Western economic sanctions if they disobey the ICC summons.

"We have agreed that God-willing, next year URP and TNA will form the next government," Ruto told thousands of supporters at a rally by his United Republican Party and Kenyatta's The National Alliance party in the Rift Valley town of Nakuru, 140 km northwest of the capital Nairobi.

Eight cabinet ministers and several lawmakers were there.

The ICC set the trials for crimes against humanity for April 2013, a month after presidential elections in east Africa's largest economy.

Ruto and Kenyatta's pairing raises the prospect of having Kenya's sitting president under indictment in the Hague.

Although both have said they will heed the April summons, there is speculation they will not appear. Many western governments had wanted the two men to face the court before the election.

"We have agreed we are uniting on behalf of the people of Kenya. Our alliance is not for fighting anyone. We are uniting for the sake of the people of Kenya," said Kenyatta.

"We have no hatred for anyone. We want to seek votes in a just way. And to our foreign friends, I would like to say this: We are willing to work with all, but we also demand our respect as citizens of this republic."

A Kenyan non-governmental organization known as the International Centre for Peace and Conflict filed suit on Friday at the Kenyan High Court challenging Ruto and Kenyatta's suitability for elective office, given their cases at the Hague. The suit was filed after a similar case against the two was withdrawn.

The indictment of an elected president would put Kenya in situation similar to that of Sudan, where President Omar Hassan al-Bashir is wanted by the ICC to face charges of genocide and other atrocities.

The charges against Kenyatta and Ruto and the two others have shaken a country where the political elite was once seen as almost above the law. There is concern that there may be fresh violence if the presidential hopefuls are blocked from running.

An October opinion poll showed that nearly a quarter of Kenyans expect the presidential vote in March to be marred by post-election violence.

The two will be running in a contest expected to pit them against Prime Minister Raila Odinga of the Orange Democratic Movement among others.

TAHRIR SQUARE, CAIRO -- This was the place where the revolution began: the roundish square where Egyptians celebrated Mubarak's fall.

This is where they are shouting on bullhorns again, outraged because they say the Muslim Brotherhood has stolen the revolution and is railroading though a constitution that could lock in Muslim Brotherhood rule for 50 years, bringing more Islamic law. They cry -- not against Islam -- but that an extremist interpretation is being forced down their throats by a president who critics say is acting every part the tyrant. ?

This is also a warning, they claim, of what may happen across the Middle East. The era of the Muslim?Brotherhood appears to have arrived. President Obama has hailed the Brotherhood's President Mohammed Morsi as a pragmatist who helped end the Gaza crisis. Egyptians here think the Brotherhood has conned Washington, just like it conned them.

Christians, liberals left out as Islamists back Egypt's draft constitution

"President?Obama is supporting a terrorist," a man told me amid chants of "Leave! Leave!" in Tahrir Square and "Down, down with the rule of the Muslim Brotherhood's spiritual leader." Before, it was "Down, down with Mubarak."

Morsi's decree divides Egypt
Egypt was torn in half just over a week ago when Morsi made himself more powerful than Mubarak ever was, and the kings before him. Morsi declared himself above judicial oversight, his decisions final and unassailable. He made himself, according to critics, a new pharaoh on the Nile. Imagine if, after five months in office, an American president announced that he could pass any law he pleased regardless of Congress or the U.S. Supreme Court. Imagine if he said his decisions were final and inspired by God.

After issuing a decree making himself more powerful than the courts, Egyptian president Mohamed Morsi has sparked a wave of anger – some of which is directed toward the United States. NBC's Richard Engel reports.

Morsi last night apologized for the power grab and said he didn't want the extra authorities, but that they were necessary for the good of the people and to safeguard the revolution. Dictators always say stuff like that. Burn down the village to save it.

At first Egyptians were shocked that Morsi would make such an obvious and, according to Egyptian judges, blatantly illegal move. It's clear now, as some analysts have long feared, that the brotherhood is making sure it doesn't lose power again by taking control of Egypt's constitution. The Brotherhood wants to write the rules of the game. Now they've done that too.

Protected by the president's new-found supreme and unquestionable powers, Morsi ordered his Islamist allies to finish writing the constitution and get it on his desk by the end of this week. They did it, even though many independent legal experts, Christians and opposition politicians boycotted the drafting process. The Brotherhood called the new constitution "a jewel." Many Egyptians say it leaves too much room for the implementation of Shariah law. ?

The constitution also empowers the people and government with a duty to uphold moral values, a vague clause that could pave the way for vigilante morality police. The constitution barely mentions protecting women's rights. According to women who were originally involved in the drafting process, and who subsequently left because they felt they were being ignored, clauses specifically demanding that women be protected from violence and sex trafficking were dropped because Islamists feared it would conflict with their desire to allow child brides.

ANALYSIS: Crisis tests Egyptians' constitution

The constitution has long been the Muslim Brotherhood's lodestar and, in the past, they have been willing the kill for it. In 1954, not long after a group of 'free officers' carried out a coup against the British-backed monarchy, a Brotherhood assassin tried to kill President Gamal Abdel Nasser. Nasser, a leading free officer, favored a mostly secular, pro-military constitution. The Brotherhood, an Islamist group that supports the return of Arab and Islamic unity and the revival of ancient Muslim glory and Shariah laws, couldn't accept the new rules.

The Brotherhood's assassination attempt failed. The gunman's eight bullets, fired while Nasser was giving a speech in Alexandria, all missed. The Brotherhood was banned. The group went underground, at times tolerated but more often repressed by Nasser's successors: presidents Mubarak and Anwar el-Sadat. When the revolts started against Mubarak, the Brotherhood saw that fate had given them another chance.

Muslim Brotherhood's calculated rise to power
Looking back now, it all seems so obvious, yet many Egyptians refused to see it coming. In fact, many of the secular revolutionaries backed the Brotherhood, arguing they were better allies than the hated military. The Brotherhood played its cards well.

The Brotherhood was late to join the anti-Mubarak revolts in 2011. When students and liberals initially occupied Tahrir Square, it looked like it might be a passing thing. The Brotherhood either didn't appreciate its significance, or wanted to wait to see who was winning.

I remember watching the Brothers march into the square. They arrived in a large group of perhaps five hundred. Nearly all were men. Many had beards. Most were dressed in poorly cut dark suits. They occupied a corner of Tahrir near a Kentucky Fried Chicken. They came with microphones and wood to build a platform. The other protesters in the square seemed happy to have the support of the new arrivals.

Egypt's Morsi, top judges compromise to defuse soaring tensions over decree

The protests continued to grow. Labor unions went on strike. The military enacted a coup against Mubarak. President Obama withdrew his support for Washington's long-time Arab friend. And Mubarak the president was no more.

The Brotherhood first said it wouldn't seek the new presidency at all. It promised to exist solely as an influential member of civil society. Back then, many Egyptians feared the Brotherhood. It was a semi-secret group. It had a small office in a Cairo apartment building with a sign on the door the size of an index card. Mubarak-era officials had often described the Brotherhood as a group of terrorists. One security official I know called the Brotherhood the most dangerous group in the world. But in the heady 1960s-like days after Mubarak's resignation, the Brotherhood's bad reputation only seemed to give the group more credibility. They'd been oppressed by the man. It was a new day. Everyone, it appeared, deserved a new beginning.

The Brotherhood went to work. It organized its considerable finances. It built a big new headquarters with far bigger signs on the doors. It sent its representatives around the world, especially to Washington, on a charm offensive. We've been oppressed, they claimed. We were slandered by a tyrant. We're not what you've heard. We can unite the Sunni world against Iran. We can help bring Israeli-Palestinian peace. There were many promises of a great future.

Even then, the Brotherhood's focus on the constitution was clear. The Brotherhood insisted the constitution be drafted only after a new president was elected. The military was overseeing a transition back then. The Brotherhood argued that the military couldn't be trusted to oversee the creation of such an important document. Many Egyptians agreed -- a decision some sorely regret today.

Morsi won the election by a narrow margin and then five months into his term, made himself a dictator and ordered his Islamist friends to quickly finish the constitution. Morsi has said he'll drop his extraordinary powers as soon as the constitution is approved in a referendum in December. Islamists are convinced they'll be able to use their grassroots network of activists to win the referendum like they won the elections. Western diplomats tend to agree.

Yet the United States has remained mostly silent on all this, urging both sides to stay calm and work it out. Washington's policy seems to be that what's going on is simply democracy in progress as Egyptians learn to use their new rights.

But in Tahrir Square people seem convinced the Brotherhood isn't testing its fledgling wings. They say Morsi knows exactly what he's doing, Washington be warned.?

Chinese tycoon must reapply for approval on Iceland resort: media

REYKJAVIK (Reuters) - A Chinese tycoon who wants to build a major tourist resort in a remote corner of northeast Iceland must reapply for permission to go ahead with the project, Icelandic media reported on Saturday.

Cabinet ministers, led by Industry Minister Steingrimur Sigfusson, said they were unable to make a final decision on Huang Nubo's application as much information remained unavailable, state radio RUV reported.

His plans have been highly controversial, with some commentators saying they raise questions about regional security because of Iceland's strategic location in the Arctic where several nations are competing for resources.

Huang has already agreed with municipalities in the area to lease 70 percent of a 300-square-km farm, where he plans to build a golf course, hotel and outdoor recreation area.

State radio said Huang's Iceland-registered firm Zhongkun Grimsstadir had in mid-November asked for more time to supply further information, and that it could take a few more months.

In a letter to architect Halldor Johannsson, Huang's Icelandic representative, the government said Huang should submit a new application which would be reviewed by a government committee.

Huang, who is chairman of Beijing-based Zhongkun Investment Group and was 161st on the Forbes list of the richest Chinese in 2010, plans to reapply as soon as he has gathered the information needed, RUV reported.

Iceland is recovering from its worst-ever financial crisis after the complete collapse of its top banks in 2008, and it is keen to lure foreign investment.

RUV says there would be investment of about 20 billion Iceland krona ($160 million) in the project and that 400-600 jobs could be created.

The government's decision was seen by observers as a sign the cabinet wanted to postpone the matter until after planned parliamentary elections in May next year.

Rationale

The rating on Cambridge Industrial Trust (CIT) reflects the Singapore-based

REIT's portfolio of good quality and well-located industrial property assets

and its stable cash flows. CIT's limited asset and tenant diversity tempers

these strengths. We assess the REIT's business risk profile as "satisfactory"

and its financial risk profile as "intermediate."

CIT benefits from an occupancy rate of 98.9%. The company's gross revenues of

Singapore dollar (S$) 65.0 million for the nine months ended Sept. 30, 2012,

were in line with our expectation. We anticipate that the REIT's earnings and

cash flows will remain steady over the next one to two years. This is because

CIT is likely to have limited capital expenditure needs given that its tenants

are responsible for the regular maintenance of the properties.

CIT's assets values are comparable with peers', despite the smaller average

size of assets in its 48-property portfolio. The REIT's average security

deposit per tenant of 12.5 months' rent is higher than the industry average of

three to four months' rent. In our view, the high tenancy deposit mitigates

any immediate negative cash flow impact if leases are terminated because it

provides CIT with sufficient time to find other tenants. We expect CIT's

portfolio value to rise to about S$1.2 billion by Dec. 31, 2012, from S$1.0

billion a year earlier. The management's active management of assets

(replacing smaller and underperforming assets with new properties) will drive

asset and earnings growth.

CIT has limited geographic diversity because all its assets are located in

Singapore. Tenant concentration is also high: The top 10 tenants contributed

about 49% of gross rent in the quarter ended September 2012. Single tenant

properties constitute 83% of the company's portfolio.

CIT raised a S$100 million bridge loan in early November this year to finance

the purchases of certain identified properties. The loan will increase the

company's debt-to-capital ratio to 45%, which is higher than peers', in the

next six months, from about 37% currently. The REIT is acquiring the assets to

replace two properties that the Singapore Land Authority (SLA) purchased for

S$101.6 million under its compulsory purchase mechanism. CIT expects to repay

the loan on maturity in March 2013 with the compensation from the SLA. We

expect the company's debt-to-capital ratio to decline to 36% after it repays

the loan. We do not see any risk in the receipt of compensation from the SLA.

In addition, we believe that the completion of CIT's two pre-committed

build-to-suit development projects will partially make up for the loss in

revenue from the government's acquisition of two of CIT's properties in 2012.

In our base-case scenario, we expect CIT's revenue to increase 12% year over

year to S$90 million in 2012.

Liquidity

We view CIT's liquidity as "adequate," as defined in our criteria. We estimate

that the REIT's liquidity sources will exceed its liquidity uses by more than

20% in 2012. Our liquidity assessment is based on the following major

assumptions:

-- CIT will have unrestricted cash and short-term investments of S$25

million-$30 million by the end of 2012.

-- Funds from operations will be S$30 million-S$35 million in 2012.

-- Current committed and undrawn facilities are about S$73 million.

-- Budgeted maintenance and development capital expenditure is S$55

million-S$60 million in 2012.

-- Distribution to unitholders will be about 90% of distributable income,

or S$45 million-S$50 million.

-- We expect net liquidity sources to remain positive even if EBITDA

declines 15%.

We believe that CIT has limited headroom to increase debt in 2012. The REIT is

likely to temporarily breach its target gearing (ratio of total debt to

capital) of 40% with the recent asset acquisition. However, we believe this

spike will be reversed with the SLA proceeds and we estimate CIT's gearing

will revert to about 36% by March 2013.

CIT's funding needs are minimal because of low capital expenditure

requirements due to the completion of its development and asset enhancement

projects. In the next 12 months, we believe that the REIT is not at risk of

breaching the financial covenants stipulated in its bank loans. Covenants

include a loan-to-total assets ratio of less than 60% and a ratio of net

property income to interest of more than 1.5x.

Outlook

The stable rating factors in our expectation that CIT will maintain its

business risk profile and generate adequate cash flows.

We may raise the rating if the REIT improves the overall quality of its asset

portfolio, reduces tenant concentration risk, and adopts a more conservative

financial policy.

We may lower the rating if CIT engages in overly aggressive debt-funded

acquisitions, which weaken its capital structure. We could also downgrade CIT

if the REIT's asset quality deteriorates or its net operating income comes

under pressure, weakening its credit metrics. A downgrade trigger could be a

debt-to-capital ratio of more than 40% and a debt-to-EBITDA ratio of more than

7.5x on a sustained basis.

Fracking extent report dismissed

Protesters erected a mocked-up fracking rig outside Parliament

The energy department has dismissed a report that "60% of the UK countryside could be exploited" for fracking, the controversial gas extraction method.

The Independent reported that more than 32,000 square miles could be affected, notably in south, north-west and north-east England and central Scotland.

It said it based this on official maps, but the department called the 60% figure "nonsense".

Meanwhile, about 300 people have held an anti-fracking protest in London.

The process of fracking involves pumping water and chemicals into shale rock at high pressure to extract gas.

It was temporarily banned after it was blamed for two earthquakes in Lancashire in 2011, but according to the Independent, Energy Secretary Ed Davey will soon end the moratorium.

Responding to the Independent's article, a department spokesman said: "There is a big difference between the amount of shale gas that might exist and what can be technically and commercially extracted.

"It is too early to assess the potential for shale gas but the suggestion more than 60% of the UK countryside could be exploited is nonsense.

'England's heartland'

The government is currently considering a report by an independent panel of experts published in April on the future of fracking in the UK.

The report recommended fracking should continue, but under stricter regulations.

Environmental campaign group Greenpeace has said its own analysis shows the extent of potential shale sites is widespread.

Executive director John Sauven said: "Two thirds of England, including large swathes of countryside, is now under active consideration for a risky, polluting, expensive form of fossil fuel extraction.

"The potential for shale gas to bring down bills is overhyped, while experts agree local opposition is a serious threat to the industry's viability.

"The coalition bust-up over wind energy will pale in comparison to the political spats that are likely to occur if [Chancellor] George Osborne tries to push ahead with gas fracking in the heartlands of England's countryside."

Imitation rig

Meanwhile, protesters have held a protest against fracking in the UK.

BBC reporter Ben Ando, at the scene in London, said about 300 people were marching.

They laid a mock pipeline in Grosvenor Square from the Canadian High Commission to the US embassy, as a sign of their "outrage at the continued exploitation of high-carbon tar sands", lobby group Campaign Against Climate Change said.

They later marched to Parliament Square, where they built an imitation 23ft (7m) "fracking rig" outside Parliament.

A delegation delivered a letter to Downing Street, calling for a ban on exploration and development of shale gas and coal bed methane.

"In an effort to step up the focus of attention on this harmful technique and its effect on people, landscape and ecosystems in Britain, residents of Sussex, Falkirk, Belfast, the Fylde, the Ribble Estuary and the Vale of Glamorgan have come together as a UK-wide deputation to ask for action, not words, on this crucial subject," the group, Britain & Ireland Frack Free, said in a statement.

The USO (United Service Organizations) lifts the spirits of America?s troops and their families millions of times each year at hundreds of places worldwide. We provide a touch of home through centers at airports and military bases in the U.S. and abroad, top quality entertainment and innovative programs and services.
